Notable Achievements

Handled cases under the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA), the Clean Water Act, the Occupational Safety and Health Act, the Clean Air Act, the Toxic Substances Control Act, and the Resource Conservation and Recovery Act;

Prosecuted and defended CERCLA and state law cost recovery claims in excess of $100 Million in both federal and state court actions;

Leveraged our experience of the legal and scientific issues that permeate environmental clean-up matters to achieve optimum results for our clients;

Helped parties navigate through the NYS Brownfield Cleanup Program (BCP) using new and innovative strategies to assure program eligibility, to maximize state tax credits, and to help avoid common program pitfalls resulting in wide recognition for our BCP expertise.

Leveraged our environmental knowledge, experience and relationships at the federal and state level to work with both responsible parties and developers to craft winning strategies on sites throughout the Northeast;

Assisted residential, commercial, non-profit and mixed-use developers in addressing environmental issues allowing for thousands of affordable housing units to be created as well as commercial/industrial spaces from Buffalo to Long Island;

Litigated complex commercial cases including business and shareholder disputes, real estate litigation, insurance claims and coverage, director and officer liability, breach of commercial contracts, breach of warranty, and administrative bid protests;

Counseled new corporations in structuring business entities, created corporations and LLCs in New York, and provided businesses with a wide range of legal and business advice from our unique perspective flowing from our mix of government and private practice experience;

Prepared and/or reviewed documents including Consolidation, Extension and Modification Agreements; Subordination Agreements; Recognition Agreements; UCC Financing Statements; and other ancillary loan closing documents necessary to perfect a lender’s security interest;

Handled all aspects of residential and commercial real estate transactions including contract drafting, due diligence, negotiations, contract review, lease preparation and review, land trusts, quieting title, mortgage and note preparation and more; representing parties on real estate transactions valued in excess of $22 Million;

Represented the lender on residential loans cumulatively valued in excess of $20M and assisted with smooth bank closings by resolving and avoiding the particular challenges borrowers and lenders may encounter in loan and mortgage closings;

Provided estate services including wills, trusts, and probate working with clients to accomplish their planning goals including advising them on how to protect and preserve their family’s wealth;

Assisted fiduciaries to guide them through the probate or administration process in both uncontested and contested proceedings;

Represented municipalities and public benefit corporations in various transactions relative to public property, land, and infrastructure – as former state and local public officers, our team understands government and provides cost effective assistance across the full range of issues including labor and employment, economic development, zoning and land use, environmental law, real property tax and eminent domain, as well as general municipal law.

Acted as strategic and legal advisors for nonprofit organizations of all kinds, providing practical solutions to the most complex challenges in a cost-effective manner.

Provided pro-bono legal services to individuals and entities with limited resources and hence are unable to appeal to the justice of law.
